Public Comment Period on Proposed Amendments to NYS Remedial Program Regulations to Conclude

The public comment period on NYSDEC’s proposed amendments to the 6 NYCRR Part 375 regulations governing State remedial programs, including the State Superfund Program, Brownfield Cleanup Program, and Environmental Restoration Program, will soon conclude on January 31, 2025. Interested stakeholders may continue to submit written public comments to NYSDEC via email or postmarked by January 31st.

These Part 375 amendments were proposed by NYSDEC through a Notice of Revised Rulemaking on October 16, 2024. The October 2024 proposal essentially mirrors an earlier set of the Part 375 regulatory amendments issued in February 2024. Following the public comment period on the initial, February 2024 proposal, NYSDEC identified and corrected certain discrepancies in the soil cleanup objective tables found in Part 375-6.8 but “did not make any substantive changes to the text of the proposed rulemaking” beyond those technical corrections. These corrections to the soil cleanup objective tables constituted a substantive change to the proposed regulatory amendments and required NYSDEC to issue the revised rulemaking in October 2024.
