Local Law 97 - NYC's Building Emission Law

In New York City, Local Law 97 (LL97) requires most new and existing buildings over 25,000 square feet to meet greenhouse gas (GHG) emissions limits starting in 2024.  The emissions limits become stricter every five years, thereby requiring covered buildings to undertake short- and long-term compliance planning.  The penalties for exceeding the emissions limits are assessed annually and can be steep: $268 for every ton of carbon dioxide equivalent emitted over the limit.  While building owners are legally responsible for LL97 compliance, tenants and unit owners are also integral to the practical aspects of compliance.  Furthermore, for many building owners, managers, and tenants, LL97 compliance is only one piece of a larger corporate environmental, social, and governance (ESG) policy.

Effective LL97 compliance—especially as part of broader ESG and building decarbonization planning—requires the creative and strategic integration of legal, technical, and financial considerations over the short and long term.
